Ancak ilk derece mahkemesi, 15 A\u011fustos 2020 tarihinde yap\u0131lan 5 y\u0131ll\u0131k belirli s\u00fcreli kira kontrat\u0131n\u0131 dikkate almayarak Semiha ve Yusuf Kolda\u015f&#8217;\u0131n ba\u015fka bir ta\u015f\u0131nmaz\u0131 olmad\u0131\u011f\u0131n\u0131, toplanan deliller \u00e7er\u00e7evesinde ihtiyac\u0131n ger\u00e7ek, samimi ve zorunlu bulundu\u011fu gerek\u00e7esiyle davan\u0131n kabul\u00fcne karar vermi\u015fti.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" alt=\"Ev Sahiplerine K\u00f6t\u00fc Haber! Kira kontrat\u0131 15 A\u011fustos 2020 tarihinde yap\u0131ld\u0131 ve dava 1 Aral\u0131k 2023 tarihinde a\u00e7\u0131ld\u0131. 5 y\u0131ll\u0131k olan kontrat\u0131n s\u00fcresinin dolmamas\u0131ndan dolay\u0131 ilk derece mahkemesinin verdi\u011fi karar usul ve yasaya ayk\u0131r\u0131 bulundu.<\/p>\n<p>Yarg\u0131tay 3&#8217;\u00fcnc\u00fc Dairesi kira kontrat\u0131n\u0131n 15 A\u011fustos 2025 tarihinde sona erdi\u011fini ve bu nedenle 1 Aral\u0131k 2023 tarihinde a\u00e7\u0131lan davada verilen karar\u0131n reddedilmesi gerekti\u011fini, temyiz karar\u0131n\u0131n kabul edildi\u011fini a\u00e7\u0131klad\u0131.<\/p>\n<p>Yarg\u0131tay, verilen kararda ilk derece mahkemesinin karar\u0131na y\u00f6nelik temyiz ba\u015fvurusunun kabul\u00fcne, karar\u0131n sonucuna etkili olmamak \u00fczere kanun yarar\u0131na bozulmas\u0131na karar vermi\u015f oldu.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" alt=\"Ev Sahiplerine K\u00f6t\u00fc Haber!
